Hi Gang:
On September 9, 2016 I was a guest on the Newsmax-TV program, “America Talks Live” that is hosted by J.D. Hayworth.  The topic of the two segments in which I participated was the fact that two days after the show aired America would observe the 15th anniversary of the terror attacks of September 11, 2001.
I have provided you with the links to those two segments below.  
The terror attacks of 9/11 have been central to all of my efforts to go public about the multiple failures of the immigration system and I was pleased to appear on J.D. Hayworth’s program.  I have been on his programs previously and hope to continue to join him on future shows.
My goal is simple- to provide clear, fact-based information about the true importance of our nation’s borders and immigration laws to protect America and Americans.  This is not about xenophobia or any such nonsense- a claim often made by open borders immigration anarchists.  Our immigration laws are totally and completely blind about race, religion and ethnicity and only address the issue of preventing the entry and continued presence of foreign national’s (aliens) whose presence poses a threat to the safety and well-being of our fellow citizens and our nation.
My objective has been to finally get our political leaders to create an immigration system that has real integrity to safeguard the United States from transnational criminals and international terrorists and make certain that American workers don’t lose their jobs to foreign workers.  These are the purposes behind our immigration laws.
It is not enough that we “Never Forget”- we must learn the lessons that the attacks of terror attacks of 9/11 should have taught us, along with the lessons to be found in the subsequent attacks and swiftly and effectively take those measures necessary to protect our nation and protect our citizens.
What is particularly noteworthy is that J.D. Hayworth had been a member of the House of Representatives on September 11, 2001 and was a member of the Immigration Reform Caucus that was, at the time, chaired by Congressman Tom Tancredo.  Several weeks after the terror attacks I drove to Washington to meet with Tom Tancredo at his office in Washington.  My meeting with Tom and his staff lasted a couple of hours and we discussed the nexus between immigration and national security and terrorism.
As I was driving home to New York, following that meeting, Tom’s staff called my cell phone and asked if I would be willing to testify before the Immigration Reform Caucus.  I told them I would be happy to do so but that inasmuch as I was an INS Senior Special Agent they needed to get the management at INS headquarters to agree to permit me to testify.
INS management initially gave me permission to testify but then, just hours later, reversed their position and told Congressman Tancredo that I could not testify.  They refused to provide an explanation.
I had to make the decision as to whether or not to go forward with the hearing without authorization.  
Tom told me to take some time to make careful decision.  For a couple of weeks I drove around New York City and simply observed so many of my neighbors wandering around the streets at night with a vacant look in their eyes.  Every day a veritable parade of cars and trucks drove by with flags attached to the roofs of their cars and photos of missing family members attached to the windows of their cars with hand-written notes asking, “Have you seen my husband?”  “Have you seen my wife?”  “Have you seen my son?”  “Have you seen my dad?”
Some of my neighbors were killed.  My pharmacist told me that half of his customers lost an immediate family member.
Many of the seats in my synagogue were empty, those were the seats of the victims who perished on 9/11.
The stench of the cauldron at “Ground Zero” permeated the air.  It was the stench of death.
I remembered something my dad had told me, back when I was a high school student.   He told me that it was easy to spot a “real man”- because a real man stands up when it counts!
He had died when I was 19 and he was 57.  He had been a construction worker- a plumber and had also worked in the Navy Shipyards during the Second World War building and repairing warships.  He (and my mom) will always be my biggest heroes.
I could hear his words in my head when I called Tom Tancredo and told him I would come to Washington to testify.  My country and my home town had been attacked.  I could not have had stronger reasons to speak up!
The Caucus hearing took place in November 2001 and on December 10, 2001 Tom Tancredo submitted my prepared testimony for the Immigration Reform Caucus hearing for the Congressional Record.

I have testified before more than 15 Congressional hearings in the House and Senate.  Perhaps the highest profile hearing I for which I have been called to testify was conducted on March 19, 2002 by the House Committee on the Judiciary, Subcommittee on Immigration and Claims, on the topic:



The hearing was covered by C-SPAN and the C-SPAN video is one that every member of Congress should be required to watch.  It is unfathomable how, more than 14 years after that hearing was conducted- into one of the most outrageous screw-ups, that virtually none of the promises to address the failures of the system that resulted in the terror attacks of September 11, 2001 and the subsequent failures of the immigration system that enabled two of the dead terrorist/hijackers to receive authorization to attend flight school have been kept.

On July 27, 2006 I testified before the House Subcommittee on Immigration, Border Security and Claims on the topic:

WHETHER THE ATTEMPTED IMPLEMENTATION OF THE REID-KENNEDY IMMIGRATION BILL WILL RESULT IN AN ADMINISTRATIVE AND NATIONAL SECURITY NIGHTMARE

In my testimony back then, I made my opposition to the Senate immigration bill, S.2611 abundantly clear. I noted that any member of Congress who would vote to provide lawful status and identity documents for millions of illegal aliens should be given “The MVP Award by al-Qaeda!” You can see a segment of my testimony at that hearing in a video that has been posted on You Tube.

On November 15, 2014 I was honored to join three true leaders in the United States Congress in a panel discussion on immigration- Senator Jeff Sessions and Congressmen Louis Gohmert and John Fleming.  A video of this panel discussion has been posted on the David Horowitz Freedom Center’s website under the title,  Immigration Wars

To provide you with a bit of additional material, during my remarks at the panel discussion, I referenced an Op-Ed I had written for the Washington Times in which I articulated my concerns about the previous attempt to enact Comprehensive Immigration Reform that the Washington Times published on June 22, 2007.  Senator Jeff Sessions quoted from my commentary, on three separate dates, from the floor of the U.S. Senate during the contentious floor debates.  In my piece I recommended that Comprehensive Immigration Reform be given a more honest and descriptive title, I suggested that it be renamed the “Terrorist Assistance and Facilitation Act!”  

Senator Sessions’ statement on June 27, 2007 from the floor of the U.S. Senate on the Immigration Bill  made  reference to my suggested new name to that disastrous legislation in my Washington Times Op-Ed.  His impassioned pleas to his colleagues averted a catastrophe and that legislation was defeated.  However, not unlike Freddy Krueger, Comprehensive Immigration Reform has been brought back to life through the unilateral actions of President Obama and his proposed executive actions.  Furthermore, there are politicians from both parties today who are more than willing to give this legislative betrayal of America and Americans CPR!

During my remarks I also made note of the excellent documentary produced by the Tea Party Patriots in which Senator Sessions and Congressmen Louis Gohmert and Steve King were interviewed.  I am proud to also appear in this film that is entitled,  “The Border States of America.”  The subtitle of this film makes the importance and relevance of the immigration crisis clear to all Americans:  “Every State is Now a Border State.”  I am honored to have been interviewed for this important film.
On May 2, 2013, I was interviewed by Megyn Kelly of Fox News about the failures of the immigration system that enabled the Tsarnaev brothers to carry out a terror attack at the Boston Marathon on April 15, 2013.  The video of my segment was posted on the Fox News website:
             


On December 6, 2015 I was interviewed by Tucker Carlson on Fox & Friends on the way that Tashfeen Malik, one of the two terrorists who carried out the worst terror attack in the United States since the attacks of 9/11 was able to enter the United States.

As you will see in my brief interview, I also raised other failures of the immigration system including the Visa Waiver Program and the process by which applications for immigration benefits such as political asylum and the naturalization process by which United States citizenship is conferred upon aliens.
Regrettably the interview was shorter than I would have preferred but I am pleased to have given the opportunity to provide my perspectives on national security vulnerabilities created by failures of our immigration system.

Why was it so easy for Tashfeen Malik to enter the US?

Dec. 06, 2015 – 3:23 – Retired senior special agent for INS talks need for stronger vetting on ‘Fox & Friends’

The staff of attorneys and federal agents who were assigned to the 9/11 Commission issued a report known as the 9/11 and Terrorist Travel – Staff Report of the National Commission on Terrorist Attacks Upon the United States.

This report focused specifically on the ability of the terrorists to travel around the world, enter the United States and ultimately embed themselves in the United States as they went about their deadly preparations. 

Page 54 contained this excerpt under the title “3.2 Terrorist Travel Tactics by Plot”-

Although there is evidence that some land and sea border entries (of terrorists) without inspection occurred, these conspirators mainly subverted the legal entry system by entering at airports.

In doing so, they relied on a wide variety of fraudulent documents, on aliases, and on government corruption. Because terrorist operations were not suicide missions in the early to mid-1990s, once in the United States terrorists and their supporters tried to get legal immigration status that would permit them to remain here, primarily by committing serial, or repeated, immigration fraud, by claiming political asylum, and by marrying Americans. Many of these tactics would remain largely unchanged and undetected throughout the 1990s and up to the 9/11 attack.

Thus, abuse of the immigration system and a lack of interior immigration enforcement were unwittingly working together to support terrorist activity. It would remain largely unknown, since no agency of the United States government analyzed terrorist travel patterns until after 9/11. This lack of attention meant that critical opportunities to disrupt terrorist travel and, therefore, deadly terrorist operations were missed.

It is reasonable and commonsense for a nation to prioritize the lives, health, safety and general well-being of its citizens.  Yet our nation has incredibly come to the point where the administration, members of Congress, irrespective of political affiliation, to equate the enforcement of these laws with racism, bigotry and xenophobia.  
It is particularly incomprehensible given that as the 9/11 Commission was clear on the nexus between failures of the immigration system and the ability of terrorists- and simply the 19 who carried out the attacks on September 11, 2001 but many other terrorists- in the decade prior to those deadly attacks had exploited vulnerabilities in the immigration system to enter the United States and embed themselves as they went about their deadly preparations.
Consider  Consider this excerpt from Chapter 12 of the 9/11 Commission Report:

Looking back, we can also see that the routine operations of our immigration laws-that is, aspects of those laws not specifically aimed at protecting against terrorism-inevitably shaped al Qaeda’s planning and opportunities. Because they were deemed not to be bona fide tourists or students as they claimed, five conspirators that we know of tried to get visas and failed, and one was denied entry by an inspector. We also found that had the immigration system set a higher bar for determining whether individuals are who or what they claim to be-and ensuring routine consequences for violations-it could potentially have excluded, removed, or come into further contact with several hijackers who did not appear to meet the terms for admitting short-term visitors.

Our investigation showed that two systemic weaknesses came together in our border system’s inability to contribute to an effective defense against the 9/11 attacks: a lack of well-developed counterterrorism measures as a part of border security and an immigration system not able to deliver on its basic commitments, much less support counterterrorism. 

Today hundreds of so-called “Sanctuary Cities” and several “Sanctuary States” boast that they refuse to cooperate with the federal government where the enforcement of our immigration laws are concerned.  In effect these cities and states engage in harboring and shielding aliens who are illegally present from detection by the federal government.  As a consequence they induce, encourage and aid and abet these aliens to enter the United States in violation of law and remain in the United States thereafter without authority.  These actions constitute a felony under the provisions of  a section of the Immigration and Nationality Act- specifically:  Title 8 U.S. Code § 1324 – (Bringing in and harboring certain aliens)

The starting point for any conversation or legislation concerning immigration must be the findings and recommendations of the 9/11 Commission which determined that a lack of border security, including the visa process. and fraud in the immigration benefits program enabled terrorists to enter and embed themselves in the United States, as they went about their deadly preparations.

In his historic speech before the 3rd Army on May 31, 1944, General George S. Patton said, on the strategy of holding a position:

We’re not holding anything, we’ll let the Hun do that. We are advancing constantly, and we’re not interested in holding onto anything except the enemy.”

Pushing back against Comprehensive Immigration Reform is the same as holding position. The time has come for us to advance by demanding that our borders be made truly secure and our immigration laws be effectively administered and enforced.

Comprehensive Immigration Reform violates all of the findings and recommendations of the 9/11 Commission but no one is willing to even consider how the lack of real border security and the lack of real integrity to the various components of the immigration system imperil national security and public safety.

Immigration is not a single issue but a singular issue that impacts nearly every challenge and threat confronting the United States today!  Simply stated, the immigration laws were enacted to save lives and protect the jobs of American workers.

It is not “Anti-Immigrant” to be “Pro-American!”

Our armed forces are charged with securing America’s borders externally while the DHS is supposed to secure those same borders from within.  The failures of the DHS to live up to its half of the equation are undermining the efforts, valor and incredible sacrifices of Americas men and women who serve in our military!

If our government’s failures to protect American jobs by securing our nation’s borders and effectively enforcing our immigration laws concerns you or especially if it angers you, I ask you to call your Senators and Congressional “Representative. This is not only your right- it is your obligation! 

All I ask is that you make it clear to our politicians that we are not as dumb as they hope we are!

We live in a perilous world and in a perilous era. The survival of our nation and the lives of our citizens hang in the balance.

This is neither a Conservative issue, nor is it a Liberal issue- simply stated, this is most certainly an AMERICAN issue!

You are either part of the solution or you are a part of the problem!

Democracy is not a spectator sport!
